Seller Terms and Conditions
Version Final (2026-08-26) - effective 2026-08-26
Effective Date: 26 August 2026
Last Updated: 26 August 2026
These Seller Terms and Conditions (“Seller Terms”) govern all persons and businesses that register, list, advertise, offer, sell or provide Products or Services through HobbyMart.my.
Each sale made through HobbyMart is a Transaction directly between the Buyer and the Seller. HobbyMart facilitates the Transaction as the marketplace operator; HobbyMart is not the Seller of a Third-Party Seller’s Products or Services. Both the Buyer and the Seller must comply with HobbyMart’s applicable Terms and Conditions, including these Seller Terms.
HobbyMart.my (“HobbyMart”, “we”, “us” or “our”) is operated by:
HobbyMart Trading
Business Registration No.: 202603196291 (AS0519002-V)
Support Email: [email protected]
These Seller Terms should be read together with HobbyMart's:
- Buyer Terms of Use;
- Privacy Notice;
- Buyer Protection and Dispute Policy;
- Prohibited Items Policy;
- Seller Fee Schedule;
- Auction Rules; and
- any other policies or rules published by HobbyMart from time to time.
By registering as a Seller, creating a Listing, offering a Product or Service, participating in a Transaction, accepting an order, receiving Seller Proceeds or otherwise using HobbyMart as a Seller, you agree to these Seller Terms.
If you do not agree to these Seller Terms, you must not sell through HobbyMart.
Nothing in these Seller Terms excludes or limits any obligation or right that cannot lawfully be excluded under applicable Malaysian law.
PART A — DEFINITIONS
1. Definitions
For these Seller Terms:
“Buyer” means a user who purchases, bids for, orders or attempts to acquire a Product or Service through HobbyMart.
“Seller” means any individual, partnership, company, business or other permitted person offering a Product or Service through HobbyMart.
For avoidance of doubt:
HobbyMart Trading is also considered a Seller whenever HobbyMart itself lists, offers, supplies or sells a Product or Service through HobbyMart.my.
Whenever HobbyMart acts as a Seller, the same applicable Seller obligations, standards and marketplace rules apply to HobbyMart unless the context clearly requires otherwise.
“Third-Party Seller” means a Seller other than HobbyMart Trading.
“Product” means any physical product, collectible, trading card, sealed product, merchandise, accessory or other permitted goods offered through HobbyMart.
“Service” means a permitted service offered through HobbyMart.
“Listing” means all information associated with a Product or Service offered through HobbyMart, including its title, description, photographs, condition, price, Seller information, shipping terms and other information.
“Platform” means HobbyMart.my and its related marketplace systems, functionality and services.
“Transaction” means a fixed-price purchase, successful auction purchase or other sale completed through HobbyMart.
“Point of Sale” means the time at which the Buyer's payment for a Transaction is successfully completed through the Platform.
For an auction, Point of Sale generally occurs when the winning bidder successfully completes payment.
“Confirmed Delivery” means the date on which the applicable courier, delivery provider, tracking system or other evidence reasonably relied upon by HobbyMart indicates that the Product has been delivered to the Buyer or the Buyer's nominated delivery address.
“Dispute Window” means three (3) calendar days following Confirmed Delivery.
“Seller Proceeds” means amounts attributable to a Seller from Transactions after deductions, holds, adjustments, refunds, reversals and fees permitted under these Seller Terms.
“Seller Dashboard” means the Seller-facing section of HobbyMart through which Seller information, Transactions, balances, fees and other Seller functionality may be displayed.
“Seller Fee Schedule” means the fees published by HobbyMart through the Seller Dashboard and applicable to Sellers at the relevant Point of Sale.
“Working Day” means a day other than a Saturday, Sunday or public holiday gazetted in Malaysia, on which banks in Malaysia are generally open for business.
PART B — HOBBYMART'S ROLE
2. Marketplace Operator
HobbyMart operates an online marketplace through which Sellers may offer Products and Services to Buyers.
For a Transaction involving a Third-Party Seller:
- the Seller is the supplier of the Product or Service;
- the sale is between the Buyer and Seller;
- HobbyMart facilitates the Transaction;
- HobbyMart may collect payment;
- HobbyMart may hold Seller Proceeds;
- HobbyMart may facilitate shipping information;
- HobbyMart may administer Buyer Protection;
- HobbyMart may investigate disputes; and
- HobbyMart may enforce its marketplace policies.
3. HobbyMart May Also Be a Seller
HobbyMart Trading may itself offer Products and Services through the Platform.
Where HobbyMart is identified as the Seller, HobbyMart Trading is the Seller for that Transaction.
HobbyMart does not receive an exemption from Seller obligations merely because it also operates the Platform.
The same applicable standards concerning:
- Listing accuracy;
- authenticity;
- Product condition;
- ownership;
- fulfilment;
- packaging;
- shipment;
- insurance;
- delivery;
- disputes;
- refunds; and
- compliance
apply to HobbyMart whenever HobbyMart acts as a Seller.
PART C — SELLER ELIGIBILITY
4. Minimum Age
An individual Seller must be at least 18 years old and legally capable of entering into binding agreements.
Where the Seller is a partnership, company or other business entity, the person operating the account must have authority to act for that entity.
5. Malaysia Marketplace
Unless HobbyMart expressly permits otherwise, Seller accounts are intended for Sellers operating in Malaysia.
HobbyMart may restrict Transactions involving unsupported locations.
6. Seller Registration Does Not Guarantee Approval
HobbyMart may:
- approve a Seller;
- reject an application;
- request additional information;
- require verification;
- restrict Seller functionality;
- impose Transaction limits; or
- require additional verification for higher-risk activities.
PART D — SELLER IDENTITY AND KYC
7. Accurate Information
Sellers must provide complete, accurate and current information requested by HobbyMart.
This may include:
- full legal name;
- identification information;
- telephone number;
- email address;
- residential or business address;
- business name;
- business-registration information;
- banking information;
- payout information;
- tax information; and
- other information reasonably required by HobbyMart.
8. Mandatory KYC Before Withdrawal
HobbyMart may, at its discretion, allow a Seller to create Listings or complete Transactions before full KYC verification has been completed.
However:
A Seller must successfully complete HobbyMart's required Know Your Customer (“KYC”) verification before any Seller Proceeds may be withdrawn or paid out.
No withdrawal will be permitted until HobbyMart determines that required verification has been satisfactorily completed.
9. KYC Information
HobbyMart may require:
- identity card or accepted identification document;
- identification number;
- photographs or verification images;
- proof of address;
- business-registration documentation;
- bank-account information;
- evidence of account ownership;
- telephone verification;
- email verification; or
- other reasonable verification information.
HobbyMart may use an appointed identity-verification provider to assist with KYC.
10. Reverification
HobbyMart may require a Seller to repeat or update verification where reasonably necessary, including where:
- Seller information changes;
- payout information changes;
- account ownership is questioned;
- unusual Transaction activity occurs;
- fraud is suspected;
- regulatory requirements change; or
- additional verification is reasonably required to protect the Platform.
11. Failure to Complete KYC
Where KYC has not been satisfactorily completed, HobbyMart may:
- disable withdrawals;
- hold Seller Proceeds;
- restrict new Listings;
- restrict sales;
- restrict payout-account changes;
- request additional documentation;
- suspend Seller functionality; or
- terminate an account where reasonably necessary.
Funds are not automatically forfeited merely because KYC has not been completed.
However, HobbyMart may continue holding funds where verification is required before payment can lawfully or reasonably be released.
PART E — SELLER DISCLOSURE REQUIREMENTS
12. Required Seller Information
A Seller must provide all information required by HobbyMart and applicable Malaysian law.
This may include:
- Seller or company name;
- website address, where applicable;
- email address;
- telephone number;
- business or trading address;
- Product or Service characteristics;
- full price;
- shipping charges;
- taxes;
- other mandatory charges;
- payment method;
- sale terms;
- estimated delivery or Service-completion time; and
- applicable safety or health certification.
13. Bahasa Malaysia
Where applicable law requires marketplace information to be disclosed in the national language, the Seller must provide the required information in Bahasa Malaysia.
HobbyMart may permit an English or other-language version in addition to Bahasa Malaysia.
Where HobbyMart provides specific mandatory fields for Bahasa Malaysia information, the Seller must accurately complete those fields.
14. False or Misleading Information
Sellers must not knowingly provide information that is false, inaccurate or misleading.
HobbyMart may prevent, remove or suspend a Listing where required information is incomplete or appears inaccurate.
PART F — LISTINGS
15. Seller Responsible for Listing
Every Seller is responsible for the Listings created through their account.
Listings must be:
- accurate;
- reasonably complete;
- lawful;
- not materially misleading; and
- consistent with HobbyMart policies.
16. Material Product Information
Where relevant, the Seller must accurately disclose:
- Product identity;
- brand;
- edition;
- set;
- language;
- quantity;
- model;
- condition;
- grading;
- serial or certification number;
- Product contents;
- modifications;
- repairs;
- material defects;
- damage;
- missing components;
- packaging condition; and
- other information reasonably material to the purchase.
17. Listing Photographs
Product photographs must reasonably represent the Product being offered.
The Seller must not intentionally:
- hide significant damage;
- digitally remove defects;
- materially misrepresent condition;
- use misleading photographs;
- display a different Product without disclosure;
- falsify certification information; or
- alter images in a manner intended to mislead Buyers.
18. Stock Photographs
Stock photographs may only be used where permitted by HobbyMart and where their use does not materially misrepresent the actual Product.
HobbyMart may require photographs of the specific Product for collectible or high-value Listings.
19. Collectible Condition
Condition terms such as:
- Mint;
- Near Mint;
- Excellent;
- Lightly Played;
- Played;
- Good; or
- similar descriptions
may involve reasonable subjective judgment.
Nevertheless, a Seller must not intentionally conceal significant defects or use condition terminology that the Seller knows is materially misleading.
20. Graded Products
Where a Product is represented as professionally graded, the Seller must accurately identify applicable information including:
- grading company;
- grade;
- certification number; and
- other material grading information.
The Seller must not knowingly:
- falsify a grade;
- alter a grading label;
- use counterfeit grading holders;
- falsify certification numbers; or
- represent an ungraded Product as professionally graded.
PART G — AUTHENTICITY
21. Seller Responsibility for Authenticity
Every Seller is responsible for the authenticity of Products represented as genuine.
This obligation applies equally to HobbyMart when HobbyMart is the Seller.
22. Counterfeit Goods
Counterfeit, fake or fraudulently represented Products are prohibited.
A Seller must not knowingly offer:
- counterfeit Products;
- fake branded Products;
- forged collectibles;
- fraudulent reproductions represented as genuine;
- counterfeit graded Products; or
- Products with materially false authentication information.
23. Authenticity Evidence
HobbyMart may request evidence supporting authenticity before or after a Transaction.
Evidence may include:
- purchase receipts;
- invoices;
- provenance;
- detailed photographs;
- serial numbers;
- certification numbers;
- grading information;
- authentication reports; or
- independent expert information.
24. Failure to Establish Authenticity
Where reasonable authenticity concerns exist and the Seller cannot provide satisfactory supporting evidence, HobbyMart may:
- remove the Listing;
- prevent the Transaction;
- hold Seller Proceeds;
- cancel the Transaction;
- refund a Buyer;
- restrict the Seller;
- require further verification; or
- suspend the account.
25. Listing Approval Is Not Authentication
HobbyMart's publication or approval of a Listing does not mean HobbyMart has independently authenticated the Product.
The Seller remains responsible for the Seller's representations.
PART H — OWNERSHIP AND RIGHT TO SELL
26. Legal Right to Sell
The Seller must have the legal right and authority to sell every Product or Service offered.
27. Stolen Property
Sellers must not offer stolen, unlawfully acquired or fraudulently obtained property.
HobbyMart may cooperate with authorities concerning suspected stolen property as permitted or required by law.
PART I — PROHIBITED ITEMS
28. Prohibited Products and Services
Sellers must comply with HobbyMart's Prohibited Items Policy.
A Seller must not list Products or Services prohibited by:
- Malaysian law;
- payment providers;
- applicable regulations; or
- HobbyMart policy.
HobbyMart may remove prohibited or restricted Listings without completing a Transaction.
29. Seller's Legal Responsibility
The Seller is responsible for ensuring that the Product or Service may legally be offered and supplied.
Technical ability to create a Listing does not constitute HobbyMart approval that the Product is lawful.
PART J — PRICING
30. Accurate Pricing
The Seller must accurately state the selling price.
A Seller must not advertise an artificially low or misleading price and subsequently require undisclosed mandatory payment from the Buyer.
31. Full Price
The Seller must provide information necessary for the Platform to display the full applicable Transaction price, including relevant:
- Product price;
- shipping;
- taxes; and
- mandatory charges.
32. Pricing Errors
Where a genuine material pricing error occurs, the Seller must promptly notify HobbyMart.
HobbyMart may determine whether the Transaction should:
- proceed;
- be corrected with the parties' agreement; or
- be cancelled and refunded.
Repeated or suspicious pricing errors may result in Seller restrictions.
PART K — PRODUCT AVAILABILITY
33. Available Inventory
The Seller must not knowingly list a Product that they are unable to supply.
34. Unique Products
For unique collectibles or single-quantity Products, Sellers should not knowingly sell the same Product simultaneously elsewhere without adequately managing inventory.
35. Confirmed Transactions
Once payment for a fixed-price Transaction has successfully completed, the Seller is expected to fulfil the Transaction unless:
- HobbyMart cancels it;
- fulfilment becomes unlawful;
- Buyer and Seller agree otherwise where permitted; or
- HobbyMart approves another reasonable exception.
PART L — ORDER MANAGEMENT
36. Order Acknowledgement
HobbyMart may automatically acknowledge orders through its systems.
The Seller must monitor the Seller account and respond to orders without undue delay.
37. Order Corrections
Where reasonably possible and required, Sellers must cooperate with HobbyMart mechanisms enabling Buyers to correct errors relating to an order.
38. Improper Seller Cancellation
Sellers must not repeatedly or improperly cancel confirmed Transactions.
If a Seller cannot fulfil a Transaction, the Seller must notify HobbyMart promptly.
HobbyMart may cancel and refund the Transaction.
Repeated improper cancellations may result in enforcement action.
PART M — SHIPPING AND PACKAGING
39. Seller Responsible for Shipment
The Seller is responsible for safely and securely preparing Products for shipment.
This applies to all Sellers, including HobbyMart whenever HobbyMart is the Seller.
40. Appropriate Packaging
Packaging must reasonably reflect:
- the Product type;
- Product fragility;
- Product condition;
- Product value; and
- foreseeable courier handling.
41. Collectible Protection
Collectibles must be reasonably protected against relevant risks including:
- bending;
- crushing;
- impact;
- moisture;
- movement inside packaging;
- tampering; and
- other reasonably foreseeable transit damage.
42. Shipment Insurance
The Seller is responsible for arranging an appropriate shipping method that includes shipment protection or insurance suitable for the Transaction.
Where the Product value exceeds the standard compensation or insurance available from the selected courier, the Seller remains responsible for selecting appropriate additional protection where reasonably available.
Failure to obtain sufficient insurance does not transfer the Seller's obligations to the Buyer.
43. Shipping Risk Cannot Be Transferred by Listing
A Seller may not override HobbyMart's shipping requirements through a Product description.
Statements such as:
- “shipping at Buyer's risk”;
- “Seller not responsible once shipped”;
- “risk transfers when courier collects”;
- “Buyer assumes courier risk”;
- “no responsibility after drop-off”; or
- similar statements
do not override HobbyMart's Seller shipping rules.
HobbyMart's marketplace rules prevail over conflicting shipping-risk statements placed in a Seller Listing.
44. Tracking
Where HobbyMart requires tracked shipping, Sellers must use a traceable delivery method and provide accurate tracking information.
45. False Tracking
The following constitute serious Seller misconduct:
- fabricated tracking;
- knowingly incorrect tracking;
- tracking belonging to another Transaction;
- manipulated courier evidence; or
- falsely claiming a Product was shipped.
46. Shipping Deadline
Products must be shipped within the time stated through the Listing or applicable HobbyMart rules.
Where a significant delay is expected, the Seller must promptly communicate the delay where possible.
47. Transit Loss or Damage
When determining a dispute involving shipment loss or damage, HobbyMart may consider:
- tracking;
- packaging;
- courier records;
- photographs;
- videos;
- unboxing evidence;
- insurance;
- Product condition;
- Seller evidence;
- Buyer evidence; and
- other relevant circumstances.
48. Courier Claims Are Separate
Any insurance or courier claim pursued by the Seller is separate from HobbyMart's Buyer Protection process.
HobbyMart is not required to delay a Buyer Protection decision indefinitely while the Seller pursues a courier or insurance claim.
PART N — DELIVERY AND DISPUTE WINDOW
49. Confirmed Delivery
HobbyMart may rely upon courier tracking or other reasonably reliable evidence when determining Confirmed Delivery.
50. Three-Day Dispute Window
The Buyer normally has three (3) calendar days following Confirmed Delivery to open a HobbyMart dispute.
51. Seller Proceeds During Dispute Window
Seller Proceeds may remain unavailable for withdrawal while the Dispute Window remains open.
If a qualifying dispute is opened, HobbyMart may continue holding the applicable funds until the dispute is resolved.
PART O — SELLER FEES
52. Agreement to Seller Fees
By selling through HobbyMart, the Seller agrees to pay the fees applicable to Transactions conducted through the Platform.
The current Seller Fee Schedule will be published through the Seller Dashboard or another designated Seller area.
53. Fees Apply at Point of Sale
Seller fees apply at the Point of Sale, not at the time a Product is listed.
The applicable fee for a Transaction is therefore the fee published by HobbyMart and applicable to that Transaction at the Point of Sale.
54. Fixed-Price Point of Sale
For a fixed-price purchase, the Point of Sale generally occurs when the Buyer's payment is successfully completed.
55. Auction Point of Sale
For an auction, the applicable fee will generally be determined when the winning bidder successfully completes payment.
A winning bid that has not yet been paid does not, by itself, constitute the Point of Sale for fee calculation.
56. Listing Does Not Lock Fee
Creating or publishing a Listing does not lock in the Seller fee applicable to a future Transaction.
If HobbyMart changes its Seller Fee Schedule after a Product is listed but before it is sold, the fee applicable at the Point of Sale will apply.
57. Fee Schedule Changes
HobbyMart may amend its Seller Fee Schedule from time to time.
Updated fees will be published through the Seller Dashboard or other designated Seller interface.
A fee change applies prospectively from its stated effective time or date.
It will not retrospectively change a fee already applied to a completed Transaction.
58. Different Fee Categories
HobbyMart may establish different fees according to factors such as:
- Product category;
- Seller type;
- Transaction type;
- auction or fixed-price Transaction;
- promotional programme;
- optional services;
- payment method; or
- other marketplace features.
59. Seller Responsible for Reviewing Fees
The Seller is responsible for reviewing the current Seller Fee Schedule made available through the Seller Dashboard.
Continuing to offer Products for sale after a revised Seller Fee Schedule becomes effective means future Transactions will be subject to the revised fees.
60. Fee Deduction
The Seller authorizes HobbyMart to deduct applicable fees from Seller Proceeds.
61. Fee Calculation Disputes
Where a Seller believes a fee has been incorrectly calculated, the Seller may contact HobbyMart for review.
HobbyMart may consider:
- Point of Sale;
- applicable fee schedule;
- Product category;
- Seller category;
- promotions;
- Transaction type; and
- other relevant information.
Where an error is confirmed, HobbyMart may correct the Seller balance.
PART P — SELLER PAYOUTS
62. Seller Balance Is Not Immediately Withdrawable
Payment by the Buyer does not mean Seller Proceeds immediately become withdrawable.
Seller Proceeds remain subject to HobbyMart's payout process.
63. Standard Payout Eligibility
Subject to these Seller Terms, Seller Proceeds will generally become eligible for payout after:
- Confirmed Delivery; and
- expiry of the three-calendar-day Dispute Window without an unresolved qualifying dispute.
64. Mandatory KYC Before Payout
Regardless of whether Seller Proceeds have otherwise become eligible:
Seller Proceeds cannot be withdrawn until the Seller has successfully completed HobbyMart's required KYC verification.
65. Conditions for Withdrawal
Withdrawal may be subject to:
- completed KYC;
- valid payout information;
- verification of the payout account;
- completion of the Dispute Window;
- absence of an unresolved Transaction dispute;
- deduction of HobbyMart fees;
- absence of applicable chargebacks;
- absence of applicable payment reversals;
- absence of fraud or security holds;
- settlement of negative Seller balances; and
- applicable legal or payment-provider requirements.
66. Payout Holds
HobbyMart may delay or hold Seller Proceeds where reasonably necessary in connection with:
- disputes;
- returns;
- suspected fraud;
- counterfeit concerns;
- payment-provider review;
- chargebacks;
- unauthorized payment;
KYC;
- account investigation;
- legal requirements;
- unusual Transaction activity;
- negative Seller balances; or
- another material Transaction risk.
67. Payout Processing
Once Seller Proceeds have become eligible for withdrawal under Section 63 and all applicable conditions in Section 65 have been satisfied, HobbyMart will process a Seller’s withdrawal request within five (5) Working Days of the request being submitted.
Actual receipt of funds may additionally be affected by:
- banking processing;
- payment-provider processing;
- weekends;
- public holidays;
- system processing; or
- verification requirements.
68. Payout Information
The Seller must provide accurate payout information.
The Seller must promptly update inaccurate or outdated information.
PART Q — REFUNDS, REVERSALS AND SELLER BALANCES
69. HobbyMart May Process Refunds
Where HobbyMart determines that a Buyer is entitled to a refund, HobbyMart may refund the Buyer from funds held in relation to the Transaction.
70. Refund After Seller Has Been Paid
Seller responsibility does not necessarily end merely because Seller Proceeds have already been withdrawn.
Where a subsequent valid refund, reversal or chargeback is attributable to the Transaction, HobbyMart may, to the extent permitted by law:
- deduct the amount from future Seller Proceeds;
- offset amounts payable to the Seller;
- create a negative Seller balance;
- request repayment; or
- take reasonable recovery action.
71. Amounts Owed to HobbyMart
Amounts properly owed by a Seller may include:
- Buyer refunds;
- payment reversals;
- chargebacks;
- duplicate payouts;
- unpaid HobbyMart fees;
- adjustments;
- amounts resulting from Seller misconduct; or
- other sums properly recoverable under these Seller Terms.
72. Negative Seller Balance
HobbyMart may restrict:
- withdrawals;
- new Listings;
- selling;
- Seller functionality; or
- the Seller account
while a material negative balance remains unresolved.
PART R — RETURNS
73. No General Change-of-Mind Return Requirement
Unless:
- applicable law requires otherwise;
- the Seller expressly provides a change-of-mind return policy;
- HobbyMart approves an exception; or
- another applicable policy applies,
HobbyMart does not generally require Sellers to accept returns merely because a Buyer changes their mind.
74. Approved Returns
Where HobbyMart determines through its dispute process that a Product must be returned, the Seller must cooperate with the approved return.
75. Return Shipping
Unless applicable law requires otherwise:
the Buyer is responsible for the cost of shipping an approved return to the Seller.
Where applicable law imposes a different mandatory obligation, that legal requirement will prevail.
76. Return Address
The Seller must provide or maintain appropriate return information where required.
A Seller must not deliberately prevent completion of a return ordered by HobbyMart.
77. Returned Product Inspection
The Seller should inspect a returned Product promptly.
Where the Seller believes that:
- a different Product was returned;
- components are missing;
- the Product was materially altered;
- the Product was damaged after receipt;
- counterfeit substitution occurred; or
- return fraud occurred,
the Seller must notify HobbyMart promptly and provide available evidence.
PART S — BUYER PROTECTION AND DISPUTES
78. Agreement to HobbyMart Dispute Process
By selling through HobbyMart, the Seller agrees that HobbyMart may administer disputes concerning Transactions conducted through the Platform.
79. HobbyMart Is Internal Dispute Administrator
For disputes involving Third-Party Sellers, HobbyMart acts as administrator of the Platform's internal dispute process.
HobbyMart is not acting as:
- a court;
- statutory tribunal;
- professional arbitrator;
- expert witness; or
- independent professional authenticator
merely because it investigates or decides a dispute.
80. Evidence
HobbyMart may request relevant evidence including:
- photographs;
- videos;
- pre-shipment photographs;
- packing photographs;
- unboxing recordings;
- shipping labels;
- tracking records;
- courier correspondence;
- Listing records;
- communications;
- invoices;
- receipts;
- payment records;
- grading information;
- certification information;
- serial numbers;
- authentication information;
- third-party expert opinions; and
- other relevant evidence.
81. Seller Evidence Preservation
Sellers are strongly encouraged to retain appropriate Transaction evidence, especially for high-value Products.
This may include:
- photographs of the Product before shipment;
- packaging photographs;
- tracking information;
- courier receipts;
- authentication records; and
- Transaction communications.
82. Seller Response Deadline
When HobbyMart requests evidence or a response, the Seller must respond within the deadline stated.
Unless another period is specified, the Seller should respond within:
48 hours.
83. Failure to Respond
Where a Seller:
- fails to respond;
- refuses to cooperate;
- fails to provide requested evidence;
- abandons the dispute; or
- unreasonably delays the investigation,
HobbyMart may proceed using the evidence available.
HobbyMart is not required to leave a dispute open indefinitely because a Seller does not participate.
84. Evidence Does Not Guarantee Outcome
No single piece or category of evidence automatically guarantees that a Buyer or Seller will succeed.
HobbyMart may determine the relevance, credibility and weight of evidence.
85. Evidence Standard
HobbyMart may give greater weight to evidence reasonably considered:
- contemporaneous;
- objective;
- independently verifiable;
- consistent;
- reliable; or
- complete.
HobbyMart is not required to apply formal court rules of evidence.
86. Dispute Factors
HobbyMart may consider:
- Listing details;
- Listing photographs;
- Seller disclosures;
- Buyer evidence;
- Seller evidence;
- shipping records;
- unboxing evidence;
- packaging;
- courier information;
- Product condition;
- authenticity evidence;
- payment information;
- communications;
- timing;
- consistency of statements;
- previous relevant account conduct;
- evidence integrity; and
- the overall circumstances.
87. Good-Faith Determination
HobbyMart will make its internal determination in good faith based on the evidence reasonably available at the time.
Sellers acknowledge that disputes may involve incomplete, conflicting or inconclusive evidence.
88. Available Outcomes
HobbyMart may determine an internal outcome including:
88.1 Full Refund
The Buyer receives a full refund.
88.2 Return and Refund
The Buyer must return the Product in accordance with HobbyMart's instructions before an applicable refund is completed.
88.3 Release of Seller Proceeds
The Buyer claim is rejected and applicable Seller Proceeds may be released.
88.4 Cancellation
The Transaction is cancelled.
88.5 Other Mandatory Remedy
Another remedy required by applicable law.
89. HobbyMart Decision Final Internally
HobbyMart's decision is:
final for purposes of HobbyMart's internal Buyer Protection, Seller payout and Transaction administration process, unless HobbyMart decides to reopen the dispute.
The Seller authorizes HobbyMart to implement its decision.
90. Disagreement With Decision
To the maximum extent permitted by law, disagreement with a good-faith HobbyMart internal determination does not by itself establish wrongdoing or liability by HobbyMart.
HobbyMart will not be liable merely because:
- evidence was incomplete;
- evidence conflicted;
- HobbyMart preferred particular evidence;
- the Seller disagrees with the outcome;
- another reasonable outcome could have been reached;
- new evidence later emerges; or
- another third party later reaches a different conclusion.
Nothing in this clause excludes liability that cannot lawfully be excluded.
91. Reopening a Dispute
HobbyMart may reopen or modify a previous internal decision where it later becomes aware of:
- fraud;
- manipulated evidence;
- materially false statements;
- significant new evidence;
- technical error;
- obvious administrative error;
- payment-provider information;
- chargeback information;
- courier evidence;
- authentication concerns; or
- another material circumstance.
PART T — BUYER MISCONDUCT
92. Reporting Buyer Misconduct
Sellers may report suspected Buyer misconduct, including:
- fraudulent claims;
- return fraud;
- fabricated evidence;
- payment abuse;
- chargeback abuse;
- auction manipulation;
- harassment; or
- other material misconduct.
93. HobbyMart Controls Enforcement
HobbyMart may investigate Buyer misconduct and take action including warnings, restrictions, suspension or termination.
The Seller does not have an automatic right to require HobbyMart to impose a particular sanction on a Buyer.
PART U — AUCTIONS
94. Auction Rules
Sellers using HobbyMart auctions must comply with these Seller Terms and applicable auction rules.
95. Seller Commitment
Once an auction has started and valid bids have been received, the Seller must not improperly withdraw the Product merely because:
- the price is lower than expected;
- the Seller changed their mind;
- market value changed;
- another buyer offered more elsewhere; or
- the Seller regrets listing the Product.
96. Reserve Price
Where available, a Seller who is unwilling to sell below a particular amount should use the applicable reserve-price feature.
97. Winning Bidder
A winning bidder must complete payment within three (3) calendar days of winning the auction. If payment is not received within this period, the Transaction may be treated as unpaid in accordance with Section 98.
98. Non-Paying Auction Winner
Where the winning bidder does not pay within the stipulated period:
- the Transaction may be cancelled;
- the Buyer may be prohibited from future auctions; and
- the Seller may choose to relist the Product.
99. Auction Manipulation Prohibited
A Seller must not:
- bid on their own auction;
- use another account to bid on their own auction;
- arrange for another person to artificially raise bids;
- engage in shill bidding;
- collude to manipulate prices; or
- otherwise manipulate auction results.
Serious auction manipulation may result in immediate suspension or permanent termination.
PART V — CHARGEBACKS
100. Seller Cooperation
Where a Buyer initiates a chargeback, the Seller must reasonably cooperate with HobbyMart's investigation.
HobbyMart may request Transaction and fulfilment evidence.
101. Seller-Caused Chargebacks
Where a chargeback or payment reversal is attributable to Seller conduct, HobbyMart may recover the applicable amount from the Seller.
Relevant conduct may include:
- failure to ship;
- counterfeit Products;
- materially misleading Listings;
- materially incorrect Products;
- Seller fraud; or
- other material Seller breach.
102. Chargeback Does Not Automatically Mean Seller Fault
The existence of a chargeback does not automatically establish Seller wrongdoing.
HobbyMart may investigate the circumstances before determining responsibility.
PART W — OFF-PLATFORM TRANSACTIONS
103. Circumvention Prohibited
Sellers must not intentionally use HobbyMart to identify Buyers and subsequently move the Transaction outside HobbyMart primarily to avoid:
- HobbyMart fees;
- payment controls;
- Buyer Protection;

- that a Listing will sell;
- that an auction will receive bids;
- any particular sale price;

HobbyMart does not guarantee uninterrupted Platform availability.

This limitation does not apply where liability cannot lawfully be excluded or limited.

149. Seller Fee Changes Governed Separately

The fee applicable to a Transaction remains the applicable fee at the Point of Sale.
PART AK — GENERAL TERMS
150. Listing Cannot Override HobbyMart Rules
A Seller cannot override mandatory HobbyMart marketplace policies merely by inserting contradictory wording into a Listing.
Where a Listing conflicts with these Seller Terms or an applicable mandatory HobbyMart policy, the HobbyMart policy governs Platform administration.
151. HobbyMart Also Bound When Selling
The rule in Section 150 applies equally to HobbyMart whenever HobbyMart acts as Seller.
HobbyMart cannot use its own Listing to create a lower Seller standard than the equivalent Seller standard imposed upon Third-Party Sellers.
152. Mandatory Law Prevails
Where these Seller Terms conflict with a mandatory legal requirement that cannot lawfully be excluded, the legal requirement prevails to the extent of the conflict.
153. Severability
If any provision is held invalid or unenforceable, it will be limited or interpreted to the minimum extent necessary and the remaining provisions will continue to operate.
154. No Waiver
Failure by HobbyMart to immediately enforce a provision does not necessarily waive its right to enforce the provision later.
155. Entire Agreement
These Seller Terms together with policies expressly incorporated by reference govern Seller activities through HobbyMart.
156. Assignment
A Seller may not transfer their Seller account to another person without HobbyMart's approval.

These Seller Terms are governed by the laws of Malaysia.
Disputes concerning these Seller Terms are subject to courts or tribunals of competent jurisdiction in Malaysia.
158. Notices
HobbyMart may deliver notices to a Seller through the Seller Dashboard, a Platform notification, or the email address associated with the Seller’s account, or another method reasonably likely to reach the Seller.
The Seller must keep the contact information provided to HobbyMart current, and is responsible for notices not received due to outdated or inaccurate contact information.
A notice is generally treated as received when displayed through the Seller Dashboard or Platform notification, or on the date it is sent by email, unless HobbyMart is notified that delivery failed.
A Seller may contact HobbyMart using the details in Section 160.
159. Force Majeure Events
HobbyMart will not be liable for delay or failure to perform an obligation under these Seller Terms to the extent the delay or failure results from circumstances reasonably beyond HobbyMart’s control, including natural disaster, fire, flood, war, civil unrest, act of government or regulatory authority, epidemic or pandemic, strike or labour dispute, failure of telecommunications, internet or power infrastructure, or failure of a third-party payment provider, courier or banking system.
Where reasonably practicable, HobbyMart will take reasonable steps to notify affected Sellers of a material Force Majeure Event and to resume normal Platform operations once the event has ended.
This section does not excuse a Seller from obligations owed directly to a Buyer to the extent those obligations cannot lawfully be excluded.
