Version Final (2026-08-26) - effective 2026-08-26
Effective Date: 26 August 2026
Last Updated: 26 August 2026
These Buyer Terms and Conditions (“Buyer Terms”) govern your registration, access to and use of HobbyMart.my, including purchases, auctions, payments, deliveries, communications, reviews, Buyer Protection and dispute-resolution services.
HobbyMart.my (“HobbyMart”, “we”, “us” or “our”) is operated by:
HobbyMart Trading
Business Registration No.: 202603196291 (AS0519002-V)
By registering for an account, accessing or using HobbyMart.my, purchasing a Product or Service, making payment, participating in an auction or otherwise using the Platform, you agree to these Buyer Terms.
If you do not agree to these Buyer Terms, you must not register for or use HobbyMart.my.
Nothing in these Buyer Terms excludes, restricts or modifies any right, guarantee, obligation or remedy that cannot lawfully be excluded under applicable Malaysian law.
Part A — Definitions
1. Definitions
For these Buyer Terms:
“Buyer” means a registered HobbyMart user who purchases, bids for, orders or attempts to acquire a Product or Service through the Platform.
“Seller” means any person or business offering a Product or Service for sale through HobbyMart.
“Store” means a Seller-specific storefront, profile, page or area within the Platform through which that Seller may display, list, offer or sell Products or Services.
“Shop” means the same as a Store and may be used interchangeably with the term “Store” throughout the Platform, Listings, user interface, communications or these Buyer Terms.
For avoidance of doubt:
HobbyMart Trading is also considered a Seller whenever HobbyMart itself lists, offers, supplies or sells a Product or Service through the Platform.
Unless expressly stated otherwise, all rules, obligations and standards applicable to Sellers on HobbyMart apply equally to HobbyMart whenever HobbyMart acts as a Seller.
“Third-Party Seller” means a Seller other than HobbyMart Trading.
“HobbyMart Direct Transaction” means a Transaction where HobbyMart Trading is identified as the Seller or service provider.
“Marketplace Transaction” means a Transaction where a Third-Party Seller is identified as the Seller.
“Product” means any physical item, collectible, trading card, sealed product, merchandise, accessory or other goods offered through HobbyMart.
“Service” means a service offered for purchase through HobbyMart.
“Listing” means the page, description, photographs, specifications, terms and other information associated with a Product or Service offered through the Platform.
“Platform” means HobbyMart.my and all related systems, features, services and functionality operated by HobbyMart.
“Transaction” means any purchase or successful auction transaction conducted through the Platform.
“Delivered” means the date on which the applicable courier, tracking system, delivery provider or other evidence reasonably relied upon by HobbyMart records a Product as having been delivered to the Buyer or the Buyer's nominated delivery address.
For Services, references to Delivered will, where appropriate, mean the date on which the Service is completed or made available to the Buyer.
“Dispute Window” means three (3) calendar days following Delivered.
“Buyer Protection” means HobbyMart's internal process for investigating qualifying Transaction disputes.
“Completed” means, in respect of a Transaction, that the Transaction has reached its final internal status because either the Buyer has manually confirmed completion of the Transaction, or the Dispute Window has expired without a qualifying dispute having been opened, whichever occurs first.
Part B — Eligibility and Accounts
2. Minimum Age
You must be at least 18 years old and legally capable of entering into a binding agreement to create and use a HobbyMart account.
By registering, you represent and warrant that you satisfy this requirement.
HobbyMart may request reasonable information or documentation to verify your identity, age, contact details or account information.
3. Malaysia Marketplace
HobbyMart is currently intended for Buyers and Sellers located in Malaysia.
HobbyMart may restrict or reject Transactions that fall outside geographical areas supported by the Platform.
4. Account Information
You must:
a. provide accurate, current and complete information;
b. keep your information updated;
c. maintain a valid email address and other required contact information;
d. maintain accurate delivery information;
e. protect your username, password and account credentials;
f. take reasonable measures to prevent unauthorized access to your account; and
g. promptly notify HobbyMart if you become aware of suspected unauthorized use.
You must not:
- impersonate another person;
- provide false information;
- create accounts using another person's identity without authorization;
- create multiple accounts to circumvent restrictions;
- sell, transfer or improperly share your account;
- create replacement accounts after suspension or termination without HobbyMart's approval; or
- use another account to avoid HobbyMart enforcement actions.
5. Responsibility for Account Activity
You are generally responsible for activities conducted through your account where those activities were authorized by you or resulted from your failure to reasonably protect your account credentials.
This does not affect rights or protections that cannot lawfully be excluded.
Part C — HobbyMart's Role
6. HobbyMart May Act in More Than One Capacity
HobbyMart operates an online marketplace through which Sellers and Buyers may transact.
HobbyMart may also itself act as a Seller.
Accordingly, HobbyMart may perform one or more of the following roles:
6.1 Marketplace Operator
Where a Third-Party Seller is identified as the Seller, HobbyMart operates the marketplace and facilitates the Transaction.
6.2 Seller
Where HobbyMart Trading is identified as the Seller, HobbyMart itself is the Seller and contracting party for that Product or Service.
6.3 Payment Facilitator
HobbyMart may collect or facilitate payment for Transactions whether the Seller is a Third-Party Seller or HobbyMart itself.
6.4 Dispute Administrator
HobbyMart administers the Platform's Buyer Protection and internal dispute process.
7. Seller Identity
The Seller applicable to a Transaction should be identified in the Listing, Transaction details, checkout information, receipt or other information made available through the Platform.
Buyers should check the identity of the Seller before completing a Transaction.
The fact that a Listing:
- appears on HobbyMart;
- is promoted by HobbyMart;
- is featured by HobbyMart;
- uses HobbyMart payment services; or
- appears in a HobbyMart promotion
does not by itself mean HobbyMart is the Seller.
Where HobbyMart Trading is identified as the Seller, HobbyMart is the Seller for that Transaction.
8. HobbyMart Subject to Seller Rules When Selling
Whenever HobbyMart acts as a Seller, HobbyMart will be subject to the same applicable Seller rules, obligations and standards imposed on other Sellers through these Buyer Terms and HobbyMart's applicable marketplace policies.
HobbyMart does not receive an exemption from Seller obligations merely because it also operates the Platform.
This includes, where applicable, requirements concerning:
- accurate Listings;
- authenticity;
- Product condition;
- fulfilment;
- secure packaging;
- shipment protection;
- shipping responsibility;
- disclosure of defects;
- cooperation with disputes;
- returns;
- refunds; and
- compliance with applicable law.
Where any provision of these Buyer Terms refers to obligations of a “Seller”, that provision includes HobbyMart whenever HobbyMart is acting as the Seller unless the context clearly requires otherwise.
Part D — Listings and Seller Responsibility
9. Seller Responsibility for Listings
The Seller is responsible for ensuring that its Listing is accurate and not materially misleading.
This requirement applies equally to Third-Party Sellers and HobbyMart when HobbyMart acts as a Seller.
Sellers are responsible for accurately describing material information including, where applicable:
- Product identity;
- condition;
- authenticity;
- quantity;
- edition;
- language;
- grading;
- defects;
- damage;
- missing components;
- modifications;
- accessories;
- packaging condition;
- Service description; and
- other information reasonably relevant to a Buyer's purchasing decision.
10. Seller Photographs and Descriptions
Photographs and descriptions form part of the Listing.
Buyers should carefully review the complete Listing before purchasing or bidding.
Where photographs clearly disclose a condition issue or defect, the Buyer generally cannot later claim that the same clearly disclosed issue was completely undisclosed.
However, Sellers must not intentionally conceal material defects through misleading photographs, descriptions or omissions.
11. Collectible Condition
Many Products sold through HobbyMart are collectibles where condition may materially affect value.
Terms such as:
- Mint;
- Near Mint;
- Lightly Played;
- Moderately Played;
- Heavily Played;
- Damaged;
- Very Good; or
- similar descriptive terms
may involve subjective judgment unless tied to a recognized third-party grading service.
A reasonable difference of opinion concerning condition does not automatically mean that a Product was materially misrepresented.
However, a Seller must disclose material damage or defects that would reasonably affect the Product's description, usability, authenticity or value.
12. Market Value
HobbyMart does not guarantee the current or future market value of collectibles.
Prices of trading cards, sealed products, graded cards and other collectibles may increase or decrease.
Unless expressly stated as part of a specific Service, neither HobbyMart nor a Seller provides investment, financial or resale-value guarantees.
A reduction in market value after purchase does not by itself create a right to a refund.
Part E — Purchases and Contract Formation
13. Fixed-Price Transactions
For a normal fixed-price Transaction, the Transaction is confirmed once the Buyer's payment is successfully completed through the Platform.
Upon confirmation, the Seller is expected to fulfil the Transaction in accordance with:
- the Listing;
- these Buyer Terms;
- applicable HobbyMart policies; and
- applicable law.
14. Transaction Cancellation
HobbyMart may cancel or reverse a Transaction where reasonably necessary, including where there is:
- suspected fraud;
- unauthorized payment;
- payment failure;
- obvious pricing error;
- obvious Listing error;
- duplicate Transaction;
- prohibited Product;
- prohibited conduct;
- Seller inability to fulfil the Transaction;
- technical error;
- security concern;
- legal or regulatory requirement; or
- another serious issue affecting the legitimacy or completion of the Transaction.
Where a paid Transaction is cancelled and the Buyer is entitled to a refund, HobbyMart will arrange or facilitate the applicable refund.
15. Seller Cancellation
A Seller should not cancel a confirmed Transaction without reasonable grounds.
Repeated or improper Seller cancellations may result in action against the Seller under HobbyMart's Seller rules.
This requirement applies equally to HobbyMart when acting as a Seller.
Part F — Payments
16. Payment Collection
Payment may be collected by:
- HobbyMart;
- HobbyMart's payment service provider; or
- another authorized payment processor.
Collection of payment by HobbyMart does not mean HobbyMart is the Seller unless HobbyMart is identified as the Seller for that Transaction.
17. Payment Holds
HobbyMart may temporarily hold Transaction proceeds while:
- delivery is pending;
- the Dispute Window remains open;
- a dispute is being investigated;
- fraud is suspected;
- a payment provider requires a hold;
- a chargeback is pending; or
- other reasonable Transaction risks exist.
18. Seller Payment Release
For Marketplace Transactions, HobbyMart may release Seller proceeds once the applicable Transaction requirements have been satisfied.
Generally, if no qualifying dispute is opened during the three (3) calendar days following Delivered, HobbyMart may release the Seller's proceeds.
Opening a dispute within the required period may delay payment release until the matter is resolved.
19. No Duplicate Recovery
A Buyer must not intentionally obtain more than one reimbursement for the same loss.
For example, a Buyer must not knowingly receive:
- a HobbyMart refund; and
- a chargeback for the same amount
and retain both reimbursements.
If duplicate reimbursement occurs, the Buyer must return the excess amount.
Intentional duplicate recovery may constitute payment abuse and may result in account restrictions or termination.
Part G — Auctions
20. Auction Bids Are Binding
A bid placed through a HobbyMart auction constitutes a commitment to purchase the Product if the Buyer becomes the winning bidder.
Buyers must review the Listing and bid amount carefully before submitting a bid.
A bid generally cannot be cancelled merely because the Buyer:
- changes their mind;
- regrets the bid amount;
- found the Product cheaper elsewhere;
- no longer wants the Product;
- misunderstood its market value; or
- made a purchasing decision they later reconsider.
HobbyMart may correct or cancel bids in exceptional circumstances involving technical errors, fraud or other serious issues.
21. Winning Bid
When an auction closes and a winning bidder has been determined, the winning bidder is obligated to complete the purchase at the winning bid amount together with applicable charges.
22. Auction Payment Deadline
A winning bidder must complete payment within three (3) calendar days of winning the auction.
If the winning bidder does not complete payment within the stipulated period:
a. the Transaction may be cancelled;
b. the Buyer will lose the right to purchase that Product under the winning bid;
c. the Buyer may be banned from participating in future HobbyMart auctions; and
d. the Seller may elect to relist the Product.
A Seller is not required to offer the Product again to the non-paying bidder.
23. Auction Manipulation
Users must not engage in:
- shill bidding;
- artificial bid inflation;
- collusive bidding;
- use of multiple accounts to manipulate prices;
- coordination intended to distort the auction;
- bid interference; or
- other attempts to manipulate auction outcomes.
HobbyMart may cancel bids or auctions and restrict or terminate accounts where auction manipulation is reasonably suspected.
Part H — Shipping
24. Seller Shipping Responsibility
For Products requiring shipment, the Seller is responsible for securely and appropriately packaging the Product for delivery.
This responsibility applies equally to:
- Third-Party Sellers; and
- HobbyMart whenever HobbyMart acts as a Seller.
The Seller must take reasonable measures appropriate to the Product and Transaction value to protect the Product from:
- physical impact;
- bending;
- crushing;
- moisture;
- tampering;
- loss; and
- other reasonably foreseeable transit risks.
25. Shipment Insurance and Protection
The Seller is responsible for arranging appropriate shipment protection and insurance where required by HobbyMart or reasonably appropriate for the Product and Transaction value.
Failure by a Seller to obtain appropriate insurance does not automatically transfer the Seller's shipping responsibility to the Buyer.
Where loss or damage occurs, any claim between the Seller and the courier or insurer is separate from HobbyMart's determination of the Buyer's dispute.
26. Seller Cannot Transfer Shipping Responsibility
A Seller cannot override HobbyMart's shipping rules by placing conflicting language in a Listing.
For example, statements such as:
- “shipping at Buyer's risk”;
- “Seller not responsible after shipping”;
- “once courier collects, Buyer assumes all risk”;
- “Buyer accepts courier risk”; or
- similar language
do not override the Seller's responsibilities under HobbyMart's marketplace rules.
HobbyMart's shipping responsibility rules prevail over conflicting statements contained in an individual Listing.
This applies to all Sellers, including HobbyMart itself when HobbyMart acts as a Seller.
27. Transit Damage
Where a Product arrives materially damaged, HobbyMart may consider:
- photographs;
- unboxing videos;
- packaging;
- internal protection;
- outer shipping packaging;
- shipping labels;
- courier tracking;
- courier records;
- insurance;
- nature of the damage;
- condition before shipment;
- statements from the Buyer and Seller; and
- other relevant evidence.
28. Incorrect Buyer Address
The Buyer is responsible for providing a complete and accurate delivery address.
Where delivery fails solely because the Buyer supplied an incorrect or incomplete address, the Buyer may be responsible for reasonable additional delivery costs or other consequences directly resulting from that error.
Part I — Buyer Inspection and Buyer Protection
29. Inspect Your Purchase Promptly
Buyers should inspect Products promptly after delivery.
Buyers purchasing valuable collectibles are particularly encouraged to inspect:
- Product condition;
- authenticity indicators;
- seals;
- packaging;
- contents;
- quantities; and
- accessories
as soon as reasonably possible.
30. Three-Day Dispute Window
A Buyer who believes there is a qualifying problem with a Transaction should open a dispute through HobbyMart within three (3) calendar days following Delivered.
A Buyer may also manually confirm completion of a Transaction at any time after Delivered, which ends the Dispute Window early for that Transaction.
For Services, the equivalent period begins from the date on which the Service is completed or made available, where applicable.
31. Seller Payment After Dispute Window
If the Buyer does not manually confirm completion of the Transaction or open a dispute within the Dispute Window, the Transaction automatically becomes Completed at the expiry of the Dispute Window, and HobbyMart may release applicable Seller proceeds.
The expiry of HobbyMart's internal Dispute Window does not extinguish any statutory right that applicable law does not permit the parties to exclude.
32. Eligible Buyer Protection Claims
Subject to evidence and the circumstances of the Transaction, Buyer Protection may apply where:
a. the Product was not received;
b. the Seller failed to ship;
c. the Buyer received the wrong Product;
d. the Product is materially different from the Listing;
e. significant damage was not disclosed;
f. material defects were not disclosed;
g. material components described in the Listing are missing;
h. the Product arrived materially damaged;
i. the Product is counterfeit;
j. the Product is materially suspected of being counterfeit; or
k. another serious Seller-related issue occurred which HobbyMart determines appropriate for investigation.
33. Claims Generally Not Covered
Buyer Protection will generally not apply merely because:
- the Buyer changed their mind;
- the Buyer found the Product cheaper elsewhere;
- the market value decreased;
- the Buyer regrets the purchase;
- the Buyer regrets an auction bid;
- the Buyer expected a higher resale value;
- the Buyer expected an investment return;
- a disclosed defect was already reasonably visible or described;
- disclosed packaging imperfections exist;
- the Buyer has a subjective disagreement with a reasonable condition description;
- a collectible receives a lower third-party grading result than expected; or
- the Product otherwise materially matches the Listing.
This section remains subject to rights that cannot legally be excluded.
Part J — Unboxing and Evidence
34. Unboxing Video Recommended
Buyers are strongly recommended to record the complete unboxing process for Products purchased through HobbyMart.
This is particularly recommended for:
- high-value Products;
- sealed trading card products;
- individual trading cards;
- graded cards;
- rare collectibles;
- limited-edition Products; and
- Products where condition or completeness may become disputed.
Ideally, the recording should begin before the shipping package is opened and clearly show:
- the unopened parcel;
- shipping label;
- external packaging;
- opening of the parcel;
- internal packaging; and
- Product received.
35. No Automatic Rejection Without Video
An unboxing video is not automatically mandatory for every Buyer Protection claim.
A dispute will not automatically be rejected solely because an unboxing video does not exist.
However, HobbyMart may consider the absence of an unboxing recording when assessing whether the remaining evidence is sufficient, particularly where the disputed issue would ordinarily have been clearly demonstrated during unboxing.
36. Preservation of Evidence
Where a Buyer identifies a possible problem, the Buyer should preserve relevant evidence until the dispute has been resolved, including:
- Product;
- outer parcel;
- internal packaging;
- shipping labels;
- seals;
- protective material;
- accessories;
- inserts;
- cards;
- certificates; and
- other relevant materials.
Users must not intentionally alter, falsify, conceal, damage or destroy material evidence relevant to an active dispute.
Part K — Dispute Resolution
37. HobbyMart Dispute Process
HobbyMart provides an internal dispute-resolution process for Transactions conducted through the Platform.
This process is intended to allow HobbyMart to investigate disagreements between Buyers and Sellers and determine the appropriate outcome for purposes of the Platform and Transaction.
38. HobbyMart as Dispute Administrator
For Marketplace Transactions involving a Third-Party Seller, HobbyMart acts as the administrator of the internal marketplace dispute.
HobbyMart may:
- receive claims;
- obtain evidence;
- request responses;
- review records;
- communicate with the parties;
- investigate relevant circumstances; and
- determine the appropriate internal Transaction outcome.
HobbyMart is not acting as a court, statutory tribunal, professional arbitrator, expert witness or independent authentication authority merely because it investigates or decides a marketplace dispute.
39. Where HobbyMart Is Also the Seller
Where HobbyMart is the Seller, the Buyer may use the same HobbyMart dispute process.
The same Seller responsibilities and Buyer Protection standards apply to HobbyMart as would apply to another Seller.
HobbyMart does not receive a special exemption merely because it also administers the Platform.
HobbyMart will consider the dispute using the same general evidence principles and Seller standards described in these Buyer Terms.
Because HobbyMart is also the Seller in such a Transaction, HobbyMart does not represent that its internal dispute process constitutes independent third-party arbitration or adjudication.
Any determination remains an internal HobbyMart decision and does not prevent the Buyer from exercising external statutory rights that cannot legally be excluded.
40. Evidence HobbyMart May Request
HobbyMart may request any information reasonably relevant to a dispute, including:
- photographs;
- videos;
- unboxing recordings;
- Product photographs;
- packaging photographs;
- shipping labels;
- tracking records;
- courier communications;
- Listing screenshots;
- original Listing information;
- payment records;
- Platform messages;
- Buyer and Seller communications;
- serial numbers;
- certification information;
- grading information;
- authenticity information;
- photographs of seals;
- receipts;
- invoices;
- expert opinions;
- third-party authentication;
- metadata;
- timestamps; and
- other relevant evidence.
41. Weight of Evidence
No single category of evidence automatically guarantees that either party will win a dispute.
HobbyMart may determine what weight to give each piece of evidence.
HobbyMart may give greater weight to evidence that reasonably appears:
- objective;
- contemporaneous;
- independently verifiable;
- consistent;
- complete; or
- more reliable in the circumstances.
HobbyMart is not required to apply formal court rules of evidence.
42. Evidence Submitted by Both Parties
HobbyMart will generally provide both Buyer and Seller a reasonable opportunity to submit information relevant to the dispute.
HobbyMart is entitled to reach a decision based on the evidence reasonably available.
HobbyMart is not responsible for a party's failure to provide evidence that was reasonably available to that party.
43. Response Deadline
Where HobbyMart requests evidence or a response, the applicable party should respond within the deadline stated in HobbyMart's request.
Unless another deadline is specified, the response period will normally be 48 hours.
44. Failure to Respond
If either Buyer or Seller:
- fails to respond;
- refuses to cooperate;
- fails to provide requested evidence;
- abandons the dispute; or
- repeatedly delays the investigation
HobbyMart may proceed without that party and make its determination using the evidence already available.
HobbyMart is not required to keep a dispute open indefinitely because one party fails to participate.
45. Factors Considered in a Dispute
HobbyMart may consider:
- original Listing;
- Listing photographs;
- Seller disclosures;
- Buyer evidence;
- Seller evidence;
- unboxing evidence;
- shipping information;
- packaging evidence;
- courier information;
- Transaction records;
- payment information;
- communications;
- timing of events;
- authenticity evidence;
- grading or certification information;
- consistency of explanations;
- reliability of evidence;
- relevant account activity;
- suspected evidence manipulation; and
- the overall circumstances.
46. Good-Faith Decision Making
HobbyMart will make its internal determination in good faith using the information and evidence reasonably available at the time.
The parties acknowledge that some disputes may involve incomplete, conflicting or inconclusive evidence.
The fact that HobbyMart reaches a decision in favour of one party does not mean HobbyMart guarantees that its factual conclusions would necessarily be identical to conclusions reached by a court, statutory tribunal, payment provider, courier, insurer, authentication company or another third party.
Part L — Dispute Outcomes
47. Available Outcomes
Following its investigation, HobbyMart may determine that the appropriate internal Transaction outcome is:
47.1 Full Refund
The Buyer receives a full refund in accordance with HobbyMart's determination.
47.2 Return and Refund
The Buyer must return the Product in accordance with HobbyMart's return instructions before receiving the approved refund.
47.3 Release of Payment to Seller
HobbyMart determines that payment should be released to the Seller and the Buyer Protection claim is closed.
47.4 Cancellation
The Transaction is cancelled.
47.5 Legally Required Remedy
HobbyMart may provide another remedy where required by applicable law.
48. Refund Not Guaranteed
Opening a dispute does not automatically entitle the Buyer to a refund.
HobbyMart may reject a Buyer Protection claim where it reasonably determines that:
- evidence is insufficient;
- the Product materially matches the Listing;
- the issue was adequately disclosed;
- the Buyer caused the relevant damage;
- the claim falls outside Buyer Protection;
- the Buyer failed to cooperate;
- evidence appears manipulated;
- the claim appears fraudulent;
- the Buyer returned a different Product;
- the Buyer materially altered the Product after receipt; or
- another reasonable basis supports rejection.
49. Finality of Internal HobbyMart Decision
HobbyMart's determination is final for the purposes of HobbyMart's internal dispute-resolution and Transaction administration process, unless HobbyMart elects to reopen the dispute under these Buyer Terms.
This means HobbyMart may act upon its determination by:
- refunding the Buyer;
- instructing a return;
- releasing Seller payment;
- cancelling the Transaction;
- closing the dispute; or
- taking applicable account action.
A HobbyMart decision is not represented as a court judgment, statutory tribunal decision or arbitral award.
Nothing in this section removes any statutory right or remedy that cannot legally be excluded.
50. Disagreement with HobbyMart's Decision
A party's disagreement with HobbyMart's good-faith internal assessment does not by itself establish wrongdoing or liability by HobbyMart.
To the maximum extent permitted by law, HobbyMart will not be liable merely because:
- one party disagrees with its determination;
- evidence was conflicting;
- evidence was incomplete;
- HobbyMart gave greater weight to particular evidence;
- another reasonable determination could have been reached;
- new information emerges afterwards; or
- a third party later reaches a different conclusion.
51. Reopening a Decision
HobbyMart may reopen, reconsider or modify a previously closed dispute where HobbyMart subsequently becomes aware of:
- fraud;
- materially false statements;
- manipulated evidence;
- significant new evidence;
- technical error;
- administrative error;
- obvious mistake;
- chargeback information;
- payment-provider information;
- courier evidence;
- authenticity concerns; or
- another serious circumstance warranting reconsideration.
A party does not have an automatic right to repeatedly demand reconsideration merely because they disagree with the outcome.
Part M — Returns and Refunds
52. No General Change-of-Mind Returns
Unless required by applicable law or expressly approved by the Seller or HobbyMart, HobbyMart does not provide a general right to return Products simply because a Buyer changes their mind.
Buyers should therefore carefully consider a purchase before paying or bidding.
53. Approved Returns
A Buyer must not return a Product through HobbyMart's dispute process unless a return has been approved or instructed.
Where HobbyMart approves a return, the Buyer must:
- return the correct Product;
- follow the stated instructions;
- ship within the specified deadline;
- package the Product securely;
- use tracked shipping where required;
- provide proof of shipment where requested;
- include required components; and
- take reasonable steps to preserve the Product's condition.
54. Return Shipping Cost
Responsibility for the cost of an approved return will depend on the reason for the return and HobbyMart's determination of the dispute.
Where the return is approved because of a Seller-related issue, including where:
- the wrong Product was supplied;
- the Product was materially different from the Listing;
- material damage or defects were not disclosed;
- the Product arrived materially damaged due to inadequate packaging;
- material components were missing; or
- the Product was counterfeit or materially misrepresented,
the Seller will be responsible for the reasonable cost of returning the Product, unless applicable law provides otherwise.
Where a return is accepted for reasons not attributable to the Seller, including a discretionary return approved despite there being no qualifying Seller-related issue, the Buyer may be responsible for the return-shipping cost.
HobbyMart may determine the appropriate return-shipping arrangement, including the shipping method, courier, tracking requirements and reasonable shipping cost, based on the circumstances of the Transaction.
The Buyer must not incur unreasonable or unnecessary return-shipping costs and expect reimbursement without HobbyMart's prior approval.
Where applicable law requires a different allocation of return-shipping costs, the applicable legal requirement will prevail.
55. Return Tracking
HobbyMart may require a Buyer to use a tracked or otherwise verifiable return-delivery method.
The Buyer is responsible for retaining evidence of return shipment.
56. Refund Following Return
Where HobbyMart's decision requires return of a Product before refund, HobbyMart may wait until:
- the Seller receives the returned Product;
- tracking confirms delivery;
- sufficient proof of return exists; or
- HobbyMart otherwise determines that the return obligation has been satisfied.
57. Incorrect or Altered Returned Product
HobbyMart may investigate if a Seller claims that:
- a different Product was returned;
- components are missing;
- the Product was materially altered;
- the Product was damaged after delivery; or
- the return otherwise does not match the original Transaction.
HobbyMart may modify or reject the internal refund remedy where supported by the evidence, subject to applicable law.
Part N — Authenticity and Counterfeit Products
58. Counterfeit Products Prohibited
Counterfeit, fake, fraudulent or intentionally misrepresented Products are prohibited from HobbyMart.
Every Seller is responsible for the authenticity of the Products they represent as genuine.
This responsibility applies equally to HobbyMart when HobbyMart itself acts as a Seller.
59. Third-Party Listings Are Not Automatically Authenticated
HobbyMart does not independently inspect or authenticate every Product offered by Third-Party Sellers before it is listed.
The presence of a Product on HobbyMart therefore does not constitute a HobbyMart guarantee that a Third-Party Seller's Product has been professionally authenticated.
60. HobbyMart Buyer Protection Against Counterfeit Products
HobbyMart will use reasonable marketplace measures intended to protect Buyers from counterfeit Products.
These measures may include:
- investigating complaints;
- requesting evidence;
- checking certification information;
- obtaining Seller explanations;
- requesting third-party opinions;
- suspending payment;
- requiring return of Products;
- removing Listings;
- suspending Sellers; or
- terminating Seller accounts.
These measures reduce risk but do not constitute a guarantee that counterfeit Products can never appear on the Platform.
61. Authenticity Investigation
Where authenticity is disputed, HobbyMart may request:
- detailed photographs;
- close-up images;
- serial numbers;
- grading certification;
- purchase records;
- provenance information;
- authentication information;
- third-party inspection; or
- other relevant evidence.
HobbyMart may determine the weight given to any authentication source based on its apparent reliability and relevance.
62. Seller Consequences for Counterfeit Products
Where HobbyMart reasonably determines that a Seller has knowingly or materially offered counterfeit goods, HobbyMart may:
- cancel Transactions;
- refund Buyers;
- withhold applicable Seller proceeds;
- remove Listings;
- suspend selling privileges;
- permanently terminate the Seller account; and
- take other action reasonably necessary to protect the marketplace or comply with law.
These rules apply to all Sellers.
Part O — Services Sold Through HobbyMart
63. Services
HobbyMart may permit Sellers, including HobbyMart itself, to offer Services through the Platform.
The Seller providing the Service is responsible for accurately describing:
- scope;
- price;
- limitations;
- expected deliverables;
- applicable conditions; and
- other material information.
64. Seller Rules Apply to HobbyMart Services
Where HobbyMart is the provider of a Service, HobbyMart is treated as the Seller of that Service and is subject to the same applicable Seller obligations as another Seller providing an equivalent Service through HobbyMart.
Additional Service-specific terms may be displayed before purchase.
Part P — Chargebacks and Payment Disputes
65. Use HobbyMart Dispute Process First
Where reasonably practicable, Buyers should first attempt to resolve Transaction problems using HobbyMart's internal dispute process before initiating a chargeback or external payment dispute.
This allows HobbyMart to investigate the matter and attempt to resolve it.
Nothing in these Buyer Terms removes any payment or statutory right that cannot legally be excluded.
66. Chargeback Cooperation
Where a chargeback or external payment dispute occurs, the Buyer agrees to reasonably cooperate with legitimate requests for Transaction information.
HobbyMart may provide relevant Transaction evidence to:
- payment processors;
- acquiring banks;
- card issuers;
- financial institutions;
- payment networks; or
- other persons involved in investigating the payment dispute,
subject to applicable privacy and data-protection requirements.
67. Abusive Chargebacks
HobbyMart may restrict, suspend or terminate accounts associated with:
- knowingly false chargebacks;
- fraudulent chargebacks;
- repeated abusive chargebacks;
- intentional duplicate reimbursement;
- fraudulent payment disputes; or
- other material payment abuse.
Legitimate exercise of a Buyer's lawful payment rights does not by itself constitute abuse.
Part Q — Off-Platform Transactions
68. Transaction Circumvention
A Buyer must not intentionally use HobbyMart primarily to identify or contact a Seller and then move the Transaction outside HobbyMart in order to avoid:
- HobbyMart fees;
- payment controls;
- marketplace rules;
- fraud controls; or
- other Platform requirements.
69. Off-Platform Transactions
Transactions conducted independently outside HobbyMart may not qualify for:
- HobbyMart Buyer Protection;
- HobbyMart dispute resolution;
- payment assistance;
- marketplace refunds; or
- other Platform protections.
HobbyMart is generally not responsible for independently conducted off-platform transactions except where applicable law provides otherwise.

73. Preventive Action
HobbyMart is not required to wait for suspected misconduct to be finally determined by a court before taking reasonable preventive marketplace action.
HobbyMart may act where it reasonably believes an account presents a material:
- fraud risk;
- safety risk;
- payment risk;
- legal risk;
- security risk; or
- marketplace-integrity risk.
74. Serious Misconduct
HobbyMart may permanently remove users for serious misconduct including:
- fraud;
- counterfeit activity;
- fabricated evidence;
- deliberate marketplace manipulation;
- serious harassment;
- repeated payment abuse;

Part T — Reviews and Communications
75. Honest Reviews
Reviews must reflect the Buyer's genuine Transaction experience.
Buyers must not:
- submit knowingly false reviews;

- demand money or benefits in exchange for changing reviews;
- impersonate another Buyer; or
- use reviews primarily to harass another person.
HobbyMart may remove reviews that violate applicable Platform policies.
76. Platform Communications
Users must communicate appropriately through HobbyMart.
HobbyMart may access or review communications sent through Platform systems where reasonably necessary for:
- customer support;
- dispute resolution;

subject to applicable privacy requirements.
Part U — User Content
77. Content Submitted to HobbyMart
Where a Buyer submits:
- photographs;
- videos;
- reviews;
- messages;
- evidence;
- documents; or
- other content
the Buyer represents that they have the right to provide that content.
78. Permission to Use Submitted Content
The Buyer permits HobbyMart to use, reproduce, process and disclose submitted content to the extent reasonably necessary to:
- administer Transactions;
- resolve disputes;
- investigate fraud;
- communicate with Buyers and Sellers;
- operate the Platform;

80. Intellectual Property
The HobbyMart name, branding, Platform design, software, graphics, logos and other content owned by HobbyMart remain the intellectual property of HobbyMart or its respective licensors.
Except as permitted by law or expressly authorized, users may not reproduce or exploit HobbyMart intellectual property for commercial purposes without permission.
Part W — Platform Availability
81. Availability
HobbyMart aims to maintain a reliable marketplace but does not guarantee uninterrupted or error-free availability.
The Platform may occasionally be unavailable because of:
- maintenance;
- system updates;
- technical faults;
- payment-provider outages;
- network problems;
- security events; or
- circumstances outside HobbyMart's reasonable control.
82. Technical Problems Affecting Transactions
Where a technical problem materially affects an auction or Transaction, HobbyMart may take reasonable corrective action.
This may include:
- cancelling a bid;
- reversing an erroneous Transaction;
- extending an auction;
- cancelling an auction;
- correcting a technical result; or
- refunding an affected Transaction.
Part X — Limitation of Responsibility
83. Third-Party Seller Conduct
Where the Seller is a Third-Party Seller, HobbyMart does not become responsible for the Seller's independent conduct merely because HobbyMart operates the marketplace.
To the maximum extent permitted by law, HobbyMart is not responsible solely by virtue of being a marketplace operator for a Third-Party Seller's:
- misrepresentation;
- breach of contract;
- inaccurate Listing;
- failure to ship;
- inadequate packaging;
- counterfeit Product;
- defective Product;
- illegal Product; or
- other independent misconduct.
This does not remove obligations imposed directly upon HobbyMart by applicable law or these Buyer Terms.
84. No Seller Exemption for HobbyMart
Section 83 does not apply to allow HobbyMart to avoid Seller responsibility where HobbyMart itself is the Seller.
When HobbyMart acts as a Seller, HobbyMart is subject to the same applicable Seller rules and responsibilities as other Sellers.
85. Marketplace Risks
Buyers acknowledge that third-party marketplace Transactions involve risks that cannot be completely eliminated.
To the maximum extent permitted by law, HobbyMart does not guarantee that:
- every Third-Party Seller is trustworthy;
- every Third-Party Seller Listing is accurate;
- every Product listed by a Third-Party Seller is authentic;
- every Third-Party Seller will complete every Transaction;
- every delivery will succeed;
- every dispute will contain conclusive evidence; or
- every internal dispute decision will satisfy both parties.
86. No Authentication Guarantee for Entire Marketplace
HobbyMart's investigation, verification, Seller-registration or enforcement activities do not constitute a universal guarantee that every Product listed by every Third-Party Seller has been independently authenticated or inspected by HobbyMart.
87. Indirect and Speculative Loss
To the maximum extent permitted by law, HobbyMart will not be responsible for indirect, consequential or speculative loss arising solely from matters such as:
- changes in collectible market value;
- lost expected resale profit;
- lost investment appreciation;
- missed market opportunities;
- expected grading outcomes; or
- sentimental value,
except where such liability cannot legally be excluded.
88. Liability Cap
To the maximum extent permitted by applicable law, where HobbyMart is found directly liable in connection with a particular Transaction, HobbyMart's aggregate liability arising directly from that Transaction will not exceed the amount actually paid by the Buyer for that Transaction.
This limitation does not apply to liability that applicable law does not permit HobbyMart to exclude or limit.
89. Good-Faith Dispute and Enforcement Decisions
To the maximum extent permitted by law, HobbyMart will not incur liability solely because it makes a good-faith internal marketplace decision based on the evidence reasonably available at the time.
This may include decisions concerning:
- refunds;
- rejected refunds;
- returns;
- release of Seller payment;
- authenticity investigations;
- auction restrictions;
- account restrictions;
- account termination; or
- Transaction cancellation.
Nothing in this section excludes liability that cannot legally be excluded.

- financial institutions;
- insurers;

Part AB — Changes to Buyer Terms
94. Amendments
HobbyMart may amend these Buyer Terms from time to time because of:
- changes to Platform functionality;
- operational requirements;
- marketplace policies;
- fraud or security risks;
- payment requirements; or
- legal or regulatory changes.
Material changes may be communicated through:
- the Platform;
- email;
- account notification; or
- a requirement to accept updated Buyer Terms.
- Where HobbyMart issues an updated version of these Buyer Terms, the Buyer must review the updated Buyer Terms and provide the acceptance required by HobbyMart before continuing to use the Platform. A Buyer who does not accept an updated version of these Buyer Terms may have account functionality restricted or suspended until acceptance is provided.
95. Prospective Application
Unless required or permitted otherwise by law, amendments will generally apply prospectively.
Transactions already completed will generally remain governed by the terms applicable when the Transaction occurred, where appropriate.
Part AC — General Terms
96. Mandatory Legal Rights
Nothing in:
- HobbyMart Buyer Protection;
- the three-day Dispute Window;
- HobbyMart's refund policy;
- HobbyMart's return policy;
- HobbyMart's internal final decision;
- an auction rule;
- a limitation of liability; or
- another provision of these Buyer Terms
is intended to exclude, restrict or modify a right, obligation, guarantee or remedy where applicable law prohibits such exclusion.
If these Buyer Terms conflict with a mandatory legal requirement, the mandatory requirement will prevail to the extent of the conflict.
97. Seller Listing Cannot Override HobbyMart Rules
A Seller cannot override mandatory HobbyMart marketplace rules by adding conflicting terms to a Listing.
Where a Seller's Listing conflicts with these Buyer Terms or an applicable HobbyMart policy, HobbyMart's rule will apply for purposes of Platform administration unless applicable law requires otherwise.
This applies equally to HobbyMart when HobbyMart acts as a Seller.
98. Severability
If any provision of these Buyer Terms is found invalid, unlawful or unenforceable, that provision will be interpreted or limited to the minimum extent necessary.
The remaining provisions will continue in effect to the extent permitted by law.
99. No Waiver
A failure or delay by HobbyMart in enforcing a provision does not necessarily constitute a waiver of HobbyMart's right to enforce that provision later.
100. Entire Agreement
These Buyer Terms, together with policies and specific terms expressly incorporated into them, govern the Buyer's use of HobbyMart.
Additional terms may apply to particular:
- Services;
- promotions;
- auctions;
- payment methods; or
- Platform features.
101. Assignment
The Buyer may not transfer their HobbyMart account or rights under these Buyer Terms to another person without HobbyMart's approval.
HobbyMart may transfer or assign its rights and obligations as part of a legitimate transfer, restructuring or continuation of the HobbyMart business, subject to applicable law.
102. Force Majeure
To the extent permitted by law, HobbyMart will not be responsible for delays or failures caused by events reasonably outside its control, including:
- major telecommunications failures;
- widespread internet outages;
- natural disasters;
- government action;
- major courier disruption;
- payment-network outages;
- cyber incidents affecting third-party infrastructure; or
- other comparable events.
This does not remove obligations that applicable law does not permit HobbyMart to exclude.
103. Governing Law
These Buyer Terms are governed by the laws of Malaysia.
Disputes concerning these Buyer Terms are subject to the jurisdiction of courts or tribunals of competent jurisdiction in Malaysia, subject to any statutory rights or remedies available under applicable law.
Part AD — Contact and Complaints
